Professional regulations and rules of professional conduct prohibit lawyers to represent conflicting interests (§ 43a (2) BRAO - prohibition of prevarication). Therefore, a conflict check is always performed prior to any acceptance of a mandate.
Dispute resolution out-of-court
Disputes between lawyers and their clients may be resolved out-of-court upon application at the regional bar (Rechtsanwaltskammer) (pursuant to § 73 (2) No. 3 in connection to § 73 (5) BRAO) or at the mediation office (Schlichtungsstelle der Rechtsanwaltschaft) (§ 191f BRAO) at the Bundesrechtsanwaltskammer, see the website of Bundesrechtsanwaltskammer (www.brak.de), email: schlichtungsstelle@brak.de.
