German Supreme Court rules on compensation for distributions agents with the EU/EEA


The German Supreme Court has recently ruled that the claim for compensation of distribution agents acting with the EU/EEA cannot be excluded in advance if the parties choose German law (BGH, Ruling of 25.02.2016 – VII ZR 102/15). The ruling is a mile stone toppling opinions of leading commentators in this field. Enterprises using any such agreements should have them checked by legal counsel.
